Damage

Damage or loss is a very unpleasant occurrence. Luckily this does not happen very often. But if damage does occur, it must be clear:
- how to limit any further damage
- how to file a complaint and consequently how to file a final claim.

Liability

WBS: In case the goods are physically in custody of WBS, WBS is responsible.
The liability of WBS is limited to a maximum according to the filed conditions. Because the freightcharge is expressed in an amount per kilo, the maximum liability is limited to a maximum amount per kilo, and are irrespective to the contents or the value of the goods. This is ca euro 5.00 per kilo.

Carrier: In case of damage or loss during transport, the actual carrier is responsible.
The liability of the carrier is limited to a maximum according to the filed conditions. Because the freightcharge is expressed in an amount per kilo, the maximum liability is limited to a maximum amount per kilo, and can therefore be irrespective to the contents or the value of the goods.

Report damage prior to singing for receipt!
Important: at destination, upon receipt of the goods and prior to signing, it must be checked if all is intact! If signed for a clean receipt, any later complaint or claim will not be accepted by the carrier. Any irregularity must be mentioned on the receipt. It may be advisable to take photo's and in the case of severe damage to ask the assistance of a neutral survey expert.

File a complaint within the time limit.
The carrier must be notified immediately of any irregularity by filing a complaint or Preliminary Claim. The time limit may differ per carrier. Also WBS must be informed without delay in order to secure any future claim. 

To file a claim.
At the time of reporting, the extent of damage may not be known yet. In the following weeks you can establish the final claim amount. Subsequent and emotional damage cannot be claimed - it is the day-value of the goods, backed up by the purchase receipt or any other proof pertaining to its value.
WBS will file the final claim for you and take care of all correspondence with the carrier. You will receive all copies. Depending on the situation under which the damage occurred, it may take several months to finalize.

Compensation.
Whether and how compensation can be received, is formalised in the Conditions of the carriers concerned. Because transport is charged per kilo, compensation is also expressed in a maximum amount per kilo.

On this page we give you an outline of the maximum liability with regard to the several modes of transport. Based on this overview, you may consider taking transport insurance. We advise you to do so anyway in the case of Seafreight and International Roadtransport.
